These Terms of Service (“Terms”) govern your use of the PowerCup website and your purchase of products from PowerCup.

The website and products are operated and supplied by PowerCup Pty Ltd (“PowerCup”, “we”, “us” or “our”).

By accessing our website, placing an order or purchasing our products, you agree to these Terms.

1. Online Store

Our website allows customers to browse and purchase PowerCup products.

You must provide accurate and complete information when placing an order, including your contact, billing and delivery information.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • A product is unavailable;
  • Pricing or product information contains an obvious error;
  • Payment cannot be processed;
  • We reasonably suspect fraudulent or unauthorised activity; or
  • We are unable to fulfil the order.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled portion of the order.

2. Products

We make reasonable efforts to ensure product descriptions, images, nutritional information and other information displayed on our website are accurate.

Product packaging, appearance and other characteristics may occasionally differ from images displayed online.

Customers should always review the product packaging for current ingredient, allergen, preparation and nutritional information before consumption.

3. Pricing

All prices are displayed in Australian dollars (AUD) unless otherwise stated.

Where applicable, prices include GST.

Shipping charges and any other applicable charges will be displayed during checkout before you complete your purchase.

We may change our prices at any time. Price changes will not affect orders that have already been accepted by us.

4. Payment

Payment must be made using one of the payment methods available at checkout.

Your order may not be processed or dispatched until payment has been successfully received or authorised.

5. Orders

Submitting an order does not necessarily mean that we have accepted it.

We may decline or cancel an order where reasonably necessary. If payment has already been taken for an order that we subsequently cancel, we will provide an appropriate refund.

Customers are responsible for checking their order details before completing checkout.

6. Shipping and Delivery

We aim to dispatch and deliver orders within the timeframes indicated on our website. Any delivery dates or timeframes provided are estimates unless expressly stated otherwise.

Delivery times may be affected by circumstances outside our reasonable control, including courier delays, weather events, public holidays and other disruptions.

Customers are responsible for providing a complete and accurate delivery address.

Where you authorise an order to be left unattended, you accept the risks associated with the order being left at the nominated location, except to the extent that responsibility cannot lawfully be excluded.

7. Returns, Refunds and Damaged Products

Returns, refunds and replacements are handled in accordance with our Returns & Refunds Policy and the Australian Consumer Law.

We do not provide refunds or exchanges for change of mind except where we expressly agree otherwise.

Due to the nature of our products as food and consumable goods, returned products may not be accepted for resale.

Nothing in these Terms limits any rights or remedies available to you under the Australian Consumer Law.

8. Cancellations and Changes

If you need to change or cancel an order, please contact us as soon as possible.

Once an order has entered processing or has been dispatched, we may be unable to change or cancel it.

This does not affect any rights you may have under Australian Consumer Law.

9. Promotions and Discount Codes

Promotional offers and discount codes may be subject to additional conditions.

Unless otherwise stated:

  • Discount codes cannot be exchanged for cash;
  • Only one discount code may be used per order;
  • Discount codes must be entered before completing checkout; and
  • Promotions may be changed or withdrawn where reasonably necessary.

We may refuse the use of a promotion where we reasonably believe it has been obtained or used fraudulently or contrary to its stated conditions.

10. Intellectual Property

Unless otherwise stated, the content of the PowerCup website, including our branding, logos, graphics, product designs, photographs, videos, text and other materials, is owned by or licensed to PowerCup Pty Ltd.

You must not reproduce, distribute, modify or commercially exploit our website content without our prior written permission, except where permitted by law.

You must not use our website:

  • For unlawful or fraudulent purposes;
  • To interfere with the operation or security of the website;
  • To introduce malicious software or harmful code;
  • To attempt to gain unauthorised access to our systems; or

We may restrict access to our website where reasonably necessary to protect PowerCup, our customers or our systems.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded or limited under the Australian Consumer Law or other applicable legislation.

We may update these Terms from time to time.

The version published on our website at the time you place an order will generally apply to that purchase.

16. Governing Law

These Terms are governed by the laws of Victoria, Australia.

You submit to the jurisdiction of the courts and tribunals of Victoria and any courts entitled to hear appeals from them.
